MMO decides in favour of Berth 9 extension at Felixstowe

Hutchinson Ports (UK) Limited recently applied for a licence to undertake the construction and associated capital dredging works for the extension of Berth 9 at the Port of Felixstowe.

The works comprise part of a project listed at Annex II of the Directive 85/337EEC on the assessment of the effects of certain public and private projects on the environment, the Environmental Impact Assessment (EIA) Directive.

The EIA Directive has been transposed into UK law for marine works, including works requiring a marine licence under the Marine and Coastal Access Act 2009 (MACA) consent by the Marine Works (EIA) Regulations 2007 (as amended) (MWR). The application made to the Marine Management Organisation (MMO) was supported by a supplementary environmental statement and additional supporting information as required by regulation 12 of the MWR.

On the 10 February 2014 the MMO decided in favour of the Berth 9 extension. In considering the application for the marine elements of the project, in particular the supporting environmental statement, the relevant provisions of the Marine and Coastal Access Act and the responses from representations, a full and detailed assessment has been made of the potential direct and indirect effects of the proposals on human beings, fauna and flora, water, air, the landscape, material assets and the cultural heritage and the interaction between any two or more of these factors.

"We, as the appropriate authority and the regulator, endorse the findings of the environmental statement and, subject to the inclusion of the licence conditions, are of the opinion that the project will not have a significant adverse effect on the environment," said the MMO.
